INFORMATION FOR RESOLVING RESIDENTIAL MATTERS FOR FOREIGNERS IN THE CZECH REPUBLIC FROM MAY 18  – JULY 16, 2020

In context of pandemic COVID-19, the government of the Czech Republic declared a state of emergency on March 12, 2020, which will probably be ended on May 17, 2020.

There is the the procedure of the state authorities concerned dealing with the residence of foreigners after the end of the state of emergency in the Czech Republic which will be temporarily applied for a period of 60 days (until July 16, 2020).

  1. RESIDENCE OF FOREIGNERS IN THE CZECH REPUBLIC AFTER THE END OF THE STATE OF EMERGENCY A) Foreigners, whose validity of their stay in the Czech Republic expired during the state of emergency, will be able to leave the country within 60 days from the end of the state of emergency (until July 16, 2020)
  2. Beware of the illegal residents. They will not receive an exit order, those are not a legitimate stay in the country in the sense of the Act on the Residence of Foreign National, they will not be prosecuted for this offence.

During departure from the country, the police at the border will give a special stamp of confirmation that the stay in the country has been tolerated into the foreigner’s travel document.

However, the stamp does not allow entrance into the territory of other countries, the possibilities of transit are always determined by the actions of the state.

The validity of the action is time-limited until July 16, 2020 and applies only to persons who were legally residents in the Czech Republic at the time of the proclamation of the state of emergency (March 12, 2020)!

  1. B) Foreigners, who had illegally resided in the Czech Republic before the proclamation of the state of emergency, are advised to leave the country as soon as possible.
  2. C) For foreigners, who will lose their residence permit after the end of the state of emergency (May 17, 2020), also applies that they will be able to leave the country within 60 days of the end of the emergency (until July 7, 2020) without being penalized. Neither the police nor Ministry of the Interior will be issuing an exit orders to them for this period. However, the above does not apply to foreigners who have been set a time limit for departure in administrative proceedings.

ENTERING INTO THE TERRITORY OF THE CZECH REPUBLIC

Even after the end of the state of emergency, with certain exceptions, foreigners entering the Czech Republic will be required to submit a medical certificate of completion of the RT-PCR test for the presence of SARS-CoV-2 with a negative result supplemented by a confirmation from the relevant laboratory. The exception is made for family members of the Czech citizens or EU citizens residing in the Czech Republic, who are obliged to complete a 14-day quarantine after the entering.

For preventive reasons and with regard to the above-mentioned quarantine measures, foreigners will not be allowed to enter the Ministry’s workplace for a period of 14 days after entering the territory of the Czech Republic. The quarantine measure will be considered as a reason independent of the foreigner’s will, which would prevent him from fulfilling the obligation to report the place of residence in the country within 3 working days after arrival.

 

Selected situations related to the entry of foreigners into the territory after the end of the state of emergency:

  1. Foreigners, who have applied for a residence permit at an embassy abroad and their application has been granted, will be invited by the relevant embassy to appear for a long-term or short-term visa, or a long-term visa to obtain a residence permit as soon as the embassy is restored.
  2. Foreigners, who had already been granted a long-term visa to obtain a residence permit before the proclamation of the state of emergency, may arrive in the Czech Republic from May 11, 2020, assuming that this visa is still valid. In case that the six-month validity of this visa has already expired, it is necessary to apply to the relevant embassy.
  3. Foreigners, who have been granted residence permit in the Czech Republic and they have lost it, damaged it or it has been stolen, will be able to contact the relevant embassy.
  4. Foreigners, who reside abroad and do not have a valid certificate of permanent validity of their current long-term visa or long-term residence permit (including an employee card), so called transmitting label or visa, will be able to return.

SETTLEMENT OF RESIDENCE AGENDA IN THE TERRITORY

Until the withdrawal, even after the end of the state of emergency, remote access (by mail, data box) to the workplace of the Ministry of the Interior will be preferred. Access to the workplace of the Ministry of the Interior will be possible after the end of the state of emergency and only after making an appointment, with exceptions (in situations that cannot be postponed) access will be granted only to the foreigners who have made an appointment in advance or have been invited to come to the workplace.

It is possible to make an appointment, either electronically or by telephone, for all acts except those listed below.

Acts for which it will not be possible to make an appointment for a temporary period even after the end of the state of emergency and the foreigner will solve them exclusively by remote access (send by mail, to the data box), then he will be invited to come to the workplace:

  • Submission of an application for an extension of the period of validity of a permanent residence permit
  • Report loss, theft of the document
  • Notification of change of residence, change of personal status, change of travel document and other changes
  • Submission of an application for performing a change in a document or the issuance of a replacement document for a lost one, stolen or damaged document

ATTENTION!!! If the client makes an appointment to perform an act other than the one he actually intends to do, he will be seen as not having been ordered and his submission will not be accepted. He must resend the action.

Acs for which it is not necessary to order in advance:

  • Issuance of a transmitting label for the purpose of departure from the country, for workers in the international transport, critical infrastructure workers. The purpose must be proven.
  • Issuance of an exit order if the foreigner’s residence permit ended or expired up 60 days after the end of the state of emergency, July 16, 2020.
  • Submission of an application for a long-term visa, long-term or permanent residence permit for a child born in the Czech Republic (Section 88 of the Act on the Residence of Foreigners).
  • If the foreigner has previously been invited to present the original travel document or the original registration document.

Extended possibility of impersonal application for a residence permit Applications for residence permits, which must be delivered to the Ministry of the Interior in person, will also be accepted by mail, electronically from the applicant’s or his representative’s data box or electronically with the applicant’s or his representative’s guaranteed signature.

      Applications for ALL STAYS (including the employee card and the blue card) sent by mail or to the data box will be accepted by the Ministry of the Interior and assessed as if they had been submitted in person. It will not be necessary for the foreigner to appear in person at the workplace of the Ministry of the Interior within 5 days.

Deadlines for submitting applications, for reporting changes and other facts The proclamation pf the state of emergency is considered as an obstacle independent of the will of the foreigner, which prevented him from submitting the application within the statutory time limit (§ 47 para. 3, § 60 para. 4 of the Aliens Residence Act). If the application 5 for the grant or extension of a residence permit is submitted after the statutory deadline, the state of emergency will be recognized as a relevant reason for such late submission and the application will be accepted and processed in the standard way. If the deadline for submitting the application expires after the end of the state of emergency, the applicant must already state the reasons for the late submission of the application and prove it upon request. These reasons will be assessed individually.

Flaw of submitted applications and deadline for their elimination

In case that the submitted application (except for the application for the issuance or extension of a long-term visa) has defects (ie in particular not all required requisites were documented or requirements did not meet the requirements), the Ministry of the Interior invites the applicant to remove them, to which shall set a deadline. Currently, deadlines are set and will continue to be longer after the end of the state of emergency than before the proclamation of the state of emergency, especially in view of the difficult public access to state authorities. If the foreigner does not manage to remove the defects within the fixed period, he may request in writing to extend it or to suspend the proceedings before the expiry of the period. The application should state the reason why he needs to extend the period or suspend the proceedings.

 EMPLOYMENT OF FOREIGNERS

  1. Termination of the employee card The Government’s crisis measure referred to in Article IV, item 3 of Government Resolution No. 495 of April 30, 2020 was interrupted for the duration of the state of emergency, in which the employee card expires after the termination of the employment relationship. This time does not start running again until the state of emergency is over. If the possessor of employment card terminated his employment relationship during the state of emergency or in the 60 days preceding the proclamation of the state of emergency, the employee card will not expire, the foreigner will have another 60 days after the state of emergency to change employers.
  2. Crisis notification of a change of employer or position By a government crisis measure. After the end of the state of emergency, it will no longer be possible to file crisis notifications about a change of employer. That is, the last crisis no later than May 17, 2020).
  3. 3. The possible to submit a notification of change of employer earlier than 6 months after receiving the employee card will be no longer possible after the end of the state of

Confirmation of fulfillment of conditions to the foreigner, who meets the conditions for issuing an employee card, blue card and intra-company employee transfer card, and needs to start work, even after the end of the state of emergency, the confirmation of fulfillment of conditions for issuing card will be sent by mail or to the data box if requested. The certificate may replace the biometric card until it is issued. The confirmation of starting a job will no longer be required of the foreigner in these cases.

Reopening of Czech language courses

Dear students, we would like to inform you about reopening of Czech language courses which were interrupted in March due to the pandemic.

The courses will start one by one from Saturday May 16 under strict hygienic conditions.

Every student has to disinfect his hands after entering the class, and has to wear a face mask. The lecturer will wear a face shield. Every student is required to wipe his table with disinfectant and paper towel after the class.
